"Prenuptial agreement" sounds like an American movie, but in Panama it exists and has its own name: marital agreements (capitulaciones matrimoniales). It's the tool for two people to decide, calmly and before marrying, how their assets will work. This guide explains what it can include and who benefits most.

Note: general information valid as of the update date, under the Family Code (Law 3 of 1994). Confirm your case with a lawyer.

The Panamanian prenup is the marital agreement

In Panama, what other countries call a "prenuptial agreement" is instrumented through marital agreements: the agreement by which future spouses choose the economic regime of their marriage instead of letting the default one apply (participation in acquired gains). It's granted before the wedding — and, unlike other systems, can also be modified afterward.

What can be agreed

The core content is the property regime and the related provisions: which assets are each spouse's own, how common ones are managed, and how they are divided if the marriage ends. That said, the agreement is not unlimited: it must respect the limits of the Family Code. A lawyer will tell you what is valid to agree and what is not.

Who benefits most

A prenup adds the most when there's something to organize:

  • Significant prior assets of one or both.
  • Businesses or shareholdings best kept separate.
  • Second marriages, especially with children from prior relationships.
  • Inheritance expectations or family property.
  • International couples, where it helps to anticipate which law and regime apply.

How to do it well

A good prenuptial agreement is clear, balanced and well-informed: both understand what they sign, each ideally with their own counsel, and the text leaves no gray areas. A rushed or lopsided prenup creates more conflict than it prevents. Doing it in good time, before the wedding date, is part of doing it well.
