Marriage by Proxy in Panama: Getting Married Without Being Present.

When one spouse cannot attend, Panama's Family Code allows marriage by proxy: the absent person grants a special power of attorney so a third party represents them at the ceremony. This guide explains when it is used, how the power is granted, and the care it requires.

The two spouses cannot always be in the same place on the same day. For those cases, Panamanian law has an old and practical solution: marriage by proxy, one of the special marriages recognized by the Family Code. This guide explains how it works and the care it requires.

Note: general information valid as of the update date, under the Family Code (Law 3 of 1994). Given its special nature, confirm your case with a lawyer.

What it is and when it's used

Marriage by proxy allows one spouse not to be present at the ceremony and to be represented by a third party to whom they granted a special power of attorney for that purpose. It's useful when one party cannot travel to Panama or be physically present on the wedding day, but both want to formalize the bond without postponing it.

It is one of the special marriages the Family Code contemplates, alongside marriage in imminent danger of death, aboard a ship or aircraft, common-law marriage, and marriage among indigenous groups. See the overview in special marriages in Panama.

The power of attorney: where the care lies

The heart of this figure is the special power of attorney. A generic power won't do: it must be granted in a way that clearly identifies whom the marriage will be contracted with, and for that specific act. A poorly drafted or incomplete power can invalidate or delay the ceremony.

That's why drafting the power — and correctly legalizing or apostilling it if granted abroad — is where legal assistance matters: an error here isn't just another formality, it's the marriage itself.

The other requirements still apply

Marriage by proxy does not exempt the rest: identity of the spouses, prenuptial medical certificate, witnesses and — if a foreigner is involved — apostilled documents. See requirements to get married in Panama and how a foreigner gets married.
