    a: "No. The certificate is requested per fiscal year and evidences a factual situation — presence or permanent home — that must already have occurred. - q: "What has to be done before applying for the certificate?"
    a: "There is a chain of dependencies. To that add the duly authenticated lease or title to the property, utility bills in the applicant's name, and documentation evidencing connection to the country."

    a: "It is issued for a specific fiscal year. Anyone needing to evidence tax residency on a continuing basis must apply again for each year, which makes maintaining the file an annual task rather than a one-off procedure."
  - q: "How long does the migratory movement certificate take?"
    a: "Average response time is three to five business days and the mandatory cost is five balboas in fiscal stamps. The application is filed with the National Immigration Service, in person or through a legal representative, with the relevant form and a copy of the passport."

## The certificate always lags behind

This is the calendar mistake that disrupts the most plans: assuming the tax residency certificate is obtained whenever you decide to obtain it.

It does not work that way. The certificate **evidences a factual situation that has already occurred**. It is requested per fiscal year, and there is no certificate for a year that has not yet elapsed or whose criterion has not yet been met. Added to the months of processing, this means the document arrives considerably later than almost everyone calculates.

Anyone who needs to evidence Panamanian tax residency by a particular date has to work backwards from that date. This guide sets out the links in the chain.

## The chain of prior steps

The steps are not independent: each depends on the one before. Skipping the order is the most common cause of stalled files.

**1. Passport registration with Immigration.** This is the invisible link and the one that surprises most. If your passport is not registered in the National Immigration Service system — and an entry stamp alone does not register it — there is no history to certify. It is resolved in a single visit, in person or by power of attorney, with a wait at the office typically running from two to four hours.

**2. Migratory movement certificate.** Issued by the National Immigration Service, it records every entry to and exit from the territory with its dates. Average response time: **three to five business days**. Mandatory cost: **five balboas in fiscal stamps**. It is the evidence the tax administration uses to count days.

**3. Housing documentation.** Public Registry certification of the property or the public deed if you own it; a lease duly authenticated before a notary if you rent.

**4. Utility bills** in the applicant's name, showing actual consumption.

**5. Documentation evidencing connection to the country**, particularly important where the 183 days are not reached.

**6. Filing the application.** Submitted through the electronic platform, with a letter addressed to the Director General stating full identification, exact address, contact details, type of activity, **whether the certificate is sought for a named treaty or for general use**, the year requested, and the justification of need.

## The timelines, added up

| Step | Time |
| --- | --- |
| Passport registration with Immigration | 1 day (2–4 hours waiting) |
| Migratory movement certificate | 3–5 business days |
| Gathering and authenticating documents | Variable, weeks |
| **Resolution of the application** | **3–5 months** |
| Remediation, if the administration raises observations | Up to 2 additional months |

Applications are handled **in order of receipt**.

## What this means as an actual calendar

Suppose someone begins meeting the criterion during a given fiscal year. To evidence tax residency for that year they need, at minimum:

- the **year to have elapsed**, or the criterion to be met and documented;
- **weeks** to gather and authenticate documentation;
- **three to five months** of processing;
- and, where observations arise, **up to two months more**.

In practical terms, **the first year's certificate arrives well into the following year**. Anyone who needs it by a specific date should start building the file two years ahead, not two months.

## Decisions to make when applying

**General use or a named treaty.** This is not a form-filling detail. If your country holds a double taxation treaty with Panama, the certificate can be issued for that specific treaty and activate its benefits. If it does not, it is requested for general use, and its function will be evidential and for self-certification before financial institutions.

**The year requested.** The certificate refers to a specific fiscal year. Note that Article 762-N allows presence to be evidenced **in the fiscal year or in the immediately preceding one**, which can sometimes cover two years with a single concentrated effort of presence.

## The myths that cost the most

**"I apply and I'll have it in a few weeks."** The stated period is approximately three months, and in practice it runs longer.

**"The entry stamp in my passport is enough to prove my days."** The stamp evidences an entry, not a history. The evidence is the migratory movement certificate, and to obtain it the passport must be registered first.

**"You get the certificate once and it lasts forever."** It is issued per fiscal year. Keeping residency evidenced is an annual task.

**"I can handle it all remotely."** Much of it, yes, through a representative. But the criterion the certificate evidences — presence, or a permanent home in habitual use — requires real presence in the country.

## What to do

1. **Work backwards from the date you need the document.** It is the only way the calendar adds up.
2. **Register your passport with Immigration on your next stay.** It is the link that blocks the whole chain and it takes a day.
3. **Start accumulating the file from the first year**, even if you are not applying yet: bills, lease, bank movements, migration history.
4. **Decide from the outset whether the certificate is for a treaty or for general use**, because that determines what it will do for you.
5. **Budget for the remediation window.** It is common for the administration to raise observations, and the period to address them is two months.
