One of Panama's great attractions is its **territorial tax system**: as a general rule, only **Panama-source income** is taxed, and income earned outside the country pays no Panamanian income tax. To use it safely, you need to understand **tax residency** and how it is evidenced.

> **Note:** general information current as of the date. Tax matters are sensitive and depend on your home country; always confirm with a tax advisor in both jurisdictions.

## Immigration residency ≠ tax residency

These are two different things, and confusing them is the most common mistake:

- **Immigration residency** is your right to live in Panama (friendly nations, pensioner, investor visa, etc.).
- **Tax residency** is your status as a taxpayer in Panama, evidenced by a **tax residency certificate** issued by the Directorate General of Revenue (DGI).

You can have one without the other. For Panama to recognize you as a tax resident — and to invoke double-taxation treaties — you normally need the certificate.

## How to obtain tax residency

In general terms, Panama treats as a tax resident anyone who meets one of these tests:

- **Presence:** being physically in Panama **more than 183 days** in the tax year (continuous or not); or
- **Center of interests:** having your permanent home or the center of your economic and vital interests in Panama.

Once the test is met, you apply for the **tax residency certificate** from the DGI, evidencing your presence or economic ties (home, activity, links). The certificate is the document that serves before foreign authorities.

## Why the territorial system matters

Under territorial taxation, if you are a Panamanian tax resident and your income comes from a **foreign source**, it generally **is not taxed in Panama**. This attracts:

- **Investors** who place their wealth in Panamanian structures (corporations, foundations).
- **Digital nomads and entrepreneurs** with income from clients abroad.
- **Retirees** with foreign pensions.

The typical combination is: **immigration residency** (to be able to live here) + **tax residency** (for your tax position) + a suitable **corporate structure**.

## The critical point: your home country also has a say

Being a Panamanian tax resident does not automatically end your obligations in your former country. Many countries apply **tax-exit** rules, treaty **tie-breaker** criteria, and controlled-foreign-company rules. A U.S. citizen, for example, still files with the IRS. That is why tax residency is planned by **coordinating both jurisdictions**, not just the Panamanian one.
